Terms of Service

These Terms of Service ("Terms") govern your use of Real Estate Manager Pro and the websites it powers (the "Service"), operated by Digital Solutions Group, Inc ("Real Estate Manager Pro", "we", "us"). They apply to agents who run a branded site on the Service and to visitors who browse those sites or submit enquiries. By using the Service, you agree to these Terms. They are effective as of the date shown above.

We are a software provider, not a broker

Real Estate Manager Pro provides website and customer-management software to independent real-estate agents. We are not a real-estate broker or agent, we do not represent buyers or sellers, and using the Service creates no agency, brokerage, or fiduciary relationship between you and us. Real-estate services are provided solely by the independent agent operating the site, who is responsible for their own licensing and conduct.

Accounts

To operate a branded site you need an agent account. You are responsible for the accuracy of the information you provide and for activity under your account. Keep your login credentials secure and notify us promptly of any unauthorized use.

Subscriptions & billing

• Access to the Service may require a paid subscription. Fees, billing frequency, and any limits are presented before you subscribe.
• Where applicable, payments are processed by Stripe. Subscribing authorizes recurring charges for the plan you select until you cancel.
• You can cancel a subscription at any time; cancellation takes effect at the end of the current billing period unless stated otherwise.

Your content

You retain ownership of the listings, photos, descriptions, branding, and other content you add to your site. You grant us the rights needed to host and display that content as part of providing the Service. You are responsible for ensuring you have the rights to publish the content you upload or import, and that it complies with applicable real-estate advertising, copyright, and fair-housing / anti-discrimination laws (including the federal Fair Housing Act and any state or local equivalents).

Imported listing data & accuracy

The Service can import listings from publicly available sources on your behalf. You are responsible for confirming you are permitted to display that data on your site. We respect the published access rules of source sites and may suspend an import that conflicts with them. Imported and agent-entered listing data is provided "as is" and may be incomplete, out of date, or inaccurate; we do not verify it and are not responsible for its accuracy. Listings are not offers, appraisals, or guarantees.

Leads, buyer data & communications

When a visitor contacts an agent through their site, the Service routes the enquiry and stores it in that agent's customer-management tools. As between you and us, the agent is the controller of the buyer/lead information collected through their site and is responsible for handling it lawfully — including compliance with applicable privacy, marketing, calling, texting, and anti-spam laws. How we process this data is described in our Privacy Policy.

AI features

The Service may offer optional AI-assisted features, such as property-valuation estimates and a help assistant. These outputs are informational only — they are not appraisals, financial, legal, or professional advice, and we do not guarantee their accuracy. Do not rely on them as the sole basis for any decision.

Acceptable use

You agree not to:

• Use the Service for any unlawful purpose or in violation of real-estate advertising or fair-housing regulations.
• Upload content you do not have the rights to, or that is misleading, infringing, discriminatory, or harmful.
• Attempt to access another tenant's data, or circumvent the platform's security or tenant isolation.
• Use bots or automated means to abuse the Service or import data in violation of a source's rules.

Service availability

We work to keep the Service available, but we may modify, suspend, or discontinue features, and perform maintenance that temporarily affects availability. We are not liable for interruptions outside our reasonable control.

Disclaimers & limitation of liability

The Service is provided "as is" and "as available" without warranties of any kind. We are not a party to any transaction between an agent and a buyer or seller, and we are not responsible for the accuracy of listing data or the outcome of any real-estate transaction. To the fullest extent permitted by law, Real Estate Manager Pro is not liable for indirect, incidental, or consequential damages, and our total liability for any claim relating to the Service is limited to the amount you paid us in the twelve months preceding the claim.

Indemnification

You agree to indemnify and hold harmless Real Estate Manager Pro and Digital Solutions Group, Inc from claims, losses, and expenses (including reasonable legal fees) arising out of the content you publish, your use of the Service, your dealings with visitors or clients, or your violation of these Terms or applicable law (including real-estate advertising and fair-housing laws).

Termination

You may stop using the Service and cancel your subscription at any time. We may suspend or terminate access for violation of these Terms or to protect the Service and its users. On termination, your right to use the Service ends; some records may be retained where required by law.

Governing law

These Terms are governed by the laws of the United States and the state in which Digital Solutions Group, Inc is organized, without regard to conflict-of-laws principles.

Changes to these Terms

We may update these Terms from time to time. Material changes will be reflected by the date above.
